Article 370 inoperative except one clause; the 1954 order carrying Article 35A superseded
Declaration under Article 370(3) of the Constitution (C.O. 273), Gazette of India Extraordinary, G.S.R. 562(E)
The 2019 Sankalp Patra makes two separate commitments in its Jammu and Kashmir section. The first is a restatement: "We reiterate our position since the time of the Jan Sangh to the abrogation of Article 370." The second is newer and carries a reason: "We are committed to annulling Article 35A of the Constitution of India as the provision is discriminatory against non-permanent residents and women of Jammu and Kashmir."
Both were done, and quickly — within three months of the government taking office.
Article 35A had never been a stand-alone amendment. It existed because the Constitution (Application to Jammu and Kashmir) Order, 1954 had inserted it. On 5 August 2019 a new order, C.O. 272, was published in the Gazette: "It shall come into force at once, and shall thereupon supersede the Constitution (Application to Jammu and Kashmir) Order, 1954 as amended from time to time." With the 1954 order gone, so was Article 35A. The same order provided that "All the provisions of the Constitution, as amended from time to time, shall apply in relation to the State of Jammu and Kashmir."
The next day came the second half. C.O. 273, a declaration by the President under Article 370(3) on the recommendation of Parliament, provided that "as from the 6th August, 2019, all clauses of the said article 370 shall cease to be operative except the following" — a single rewritten clause saying the whole Constitution applies to the state, without modification or exception.
The Supreme Court examined both orders and upheld the change unanimously in December 2023.
Two facts belong in the record alongside the verdict, neither of which changes it. The mechanism ran through Parliament rather than the state's own legislature: Article 370(3) requires the recommendation of the state's constituent assembly, which had not existed since 1957, and C.O. 272 read that requirement as referring to the Legislative Assembly — which was itself dissolved, with the state under President's Rule, so Parliament supplied the recommendation. And what followed was larger than the manifesto text: the Jammu and Kashmir Reorganisation Act split the state into two union territories that month. Restoration of statehood has been stated as an intention in Parliament; as of August 2026 it had not happened.
On the promise as written — abrogation of Article 370 and annulment of Article 35A — the gazette record is unambiguous. Our verdict is accurate.
