Reservation of up to 10 per cent enabled by Articles 15(6) and 16(6); income ceiling ₹8 lakh with asset exclusions
Lok Sabha Unstarred Question No. 2552, Reservation Policy for Economically Weaker Sections — answer by the Ministry of Social Justice and Empowerment
Note first what kind of promise this is. The 10 per cent EWS quota was already law when the manifesto was written: the Constitution (One Hundred and Third Amendment) Act was passed in January 2019, three months before polling. The manifesto claims it as an achievement — "We have decisively ensured" — and the forward commitment is narrow: "We will implement the law in the same spirit while ensuring that SCs, STs and OBCs continue to have their fair representation."
On that commitment the record is affirmative.
The quota operates at the centre as described. The Ministry of Social Justice and Empowerment sets out the framework: Articles 15(6) and 16(6), inserted by the Amendment, enable "reservation up to a maximum of 10 per cent for Economically Weaker Sections (EWSs) in admissions to educational institutions and appointments in civil posts and services", for people "not covered under the existing scheme of reservations for the Scheduled Castes, the Scheduled Tribes and the Socially and Educationally Backward Classes" whose family income is below ₹8 lakh a year. Four asset tests exclude a family regardless of income: five acres of agricultural land or more, a residential flat of 1,000 sq ft or more, a residential plot of 100 sq yards or more in a notified municipality, or 200 sq yards or more elsewhere.
The specific undertaking — that SC, ST and OBC representation would not be squeezed — was honoured in the mechanism chosen. Central educational institutions were required to expand total seats so that existing reserved and unreserved seats were not reduced, an expansion of roughly 25 per cent phased over two years, and central government recruitment applied the 10 per cent on top of existing quotas rather than within them. The manifesto promised the outcome and the government legislated for it. The Supreme Court upheld the Amendment in November 2022; we hold no copy of that judgment and rest none of the grading above on it.
Two qualifications belong in the record.
The first is that "implementation" is not a single national fact. Reservation in state services is for states to legislate. Asked specifically about Chhattisgarh, the ministry answered that the state's enabling amendment bill of 2022 "has not yet been approved. Hence, the same has not been implemented in State Government." Four years after that bill, a person in Chhattisgarh who qualifies for EWS reservation in a central job does not qualify for one in a state job. The manifesto's language did not distinguish the two.
The second is that no outcome is published. The ministry gives the criteria and the constitutional basis and no numbers — not how many posts have been filled under the quota, not how many seats taken, not how the ₹8 lakh ceiling has been reviewed against inflation since 2019. Asked whether any review is proposed, the answer is: "There is no such proposal under consideration in the Ministry." A ceiling fixed in 2019 and never revisited is a policy choice; it is also the parameter that decides who the quota reaches.
Delivered on what the promise actually committed to, and recorded as lacking context because the implementation the manifesto spoke of stops at the boundary of central government, and because the government publishes nothing that would let anyone measure the quota's effect.
BJP Sankalp Patra 2019 — Lok Sabha election manifesto
“Through this Sankalp Patra, you would get a glimpse of the challenges of the yesteryears, the indomitable efforts made by 130 crore Indians to overcome those challenges and our collective vision for the future… There are two commitments that I am extremely passionate about — doubling of farmer income and housing for all, by the year 2022.”
Lok Sabha Unstarred Question No. 2552, Reservation Policy for Economically Weaker Sections — answer by the Ministry of Social Justice and Empowerment
“(a) to (b): The Constitution (One Hundred and Third Amendment) Act, 2019 inserted Articles 15(6) and 16(6) in the Constitution, enabling reservation up to a maximum of 10 per cent for Economically Weaker Sections (EWSs) in admissions to educational institutions and appointments in civil posts and services. The objective of the policy is to provide reservation benefits to economically weaker persons who are not covered under the existing scheme of reservations for the Scheduled Castes, the Scheduled Tribes and the Socially and Educationally Backward Classes and whose family has gross annual income below Rs.8.00 lakh… Also persons whose family owns or possesses any of the following assets shall be excluded from being identified as EWSs, irrespective of the family income: i) 5 acres of Agricultural Land and above; ii) Residential flat of 1000 sq. ft. and above; iii) Residential plot of 100 sq. yards and above in notified municipalities; iv) Residential plot of 200 sq. yards and above in areas other than the notified municipalities. (c): As informed by the State Government of Chhattisgarh, The Chhattisgarh Public Services (Reservation for Scheduled Castes, Scheduled Tribes and Other Backward Classes) (Amendment) Bill, 2022, which has a provision for reservation for the Economically Weaker Sections (EWS) has not yet been approved. Hence, the same has not been implemented in State Government. (d): There is no such proposal under consideration in the Ministry.”
