M Siddiq (D) Thr Lrs v. Mahant Suresh Das & Ors — Supreme Court of India, Civil Appeal Nos. 10866-10867 of 2010, judgment of 9 November 2019
The 2019 Sankalp Patra sharpens the 2014 formulation with one word. Where the earlier manifesto promised to "facilitate the construction", this one promises "all necessary efforts to facilitate the expeditious construction of the Ram Temple in Ayodhya" — still within the framework of the Constitution, but now with a commitment about speed.
Speed is therefore the thing to check, and the record is unusually clean. Seven months into the term, on 9 November 2019, a five-judge bench of the Supreme Court decided the Ayodhya title suits. Part Q of its order gave the government a deadline of its own: "The Central Government shall, within a period of three months from the date of this judgment, formulate a scheme pursuant to the powers vested in it under Sections 6 and 7 of the Acquisition of Certain Area at Ayodhya Act 1993. The scheme shall envisage the setting up of a trust with a Board of Trustees or any other appropriate body under Section 6." The powers to be given to those trustees expressly included "the construction of a temple".
The judgment also directed a simultaneous act, which is part of the same order and belongs in the same record: five acres to be handed to the Sunni Central Waqf Board at the same time as the disputed property passed to the trust.
The government met the Court's three-month deadline. The Shri Ram Janmabhoomi Teerth Kshetra trust was constituted in February 2020, the disputed property vested in it, and the temple was consecrated on 22 January 2024 — four months before the term ended. Construction of the wider complex continued after that date.
One clarification on causation, because it matters to how the promise reads. The decisive act was the Supreme Court's, not the government's; what the government undertook, and did, was the facilitation the manifesto described — framing the scheme, constituting the trust, transferring possession, and allotting the alternative land the same order required. That is the promise as written, and it was kept within the term. Our verdict is accurate.
