Done, though after the term in which it was promised. On 6 August 2019 the President declared, on the recommendation of Parliament, that all clauses of Article 370 shall cease to be operative except one, which now reads that the whole Constitution applies to Jammu and Kashmir. The declaration is in the Gazette of India as C.O. 273. The Supreme Court upheld it unanimously in December 2023. The 2014 promise also said the party would "discuss this with all stakeholders"; the change was made while the state was under President's Rule and its elected assembly stood dissolved.
“BJP reiterates its stand on the Article 370, and will discuss this with all stakeholders and remains committed to the abrogation of this article.”No CAG performance audit published
No CAG performance audit covering this scheme has been published. The absence of an audit is not evidence that the claim is either accurate or inaccurate.
This is a constitutional and legislative act, not a spending programme, so there is no audit to cite. The primary record is the Gazette of India notification itself.
No audit period to plot — no CAG performance audit covering this scheme has been published.
Article 370 rendered inoperative except for one clause, from 6 August 2019
Jammu and Kashmir was reorganised into two union territories the same month. Statehood had not been restored as of August 2026.
Declaration under Article 370(3) of the Constitution (C.O. 273), Gazette of India Extraordinary, G.S.R. 562(E)
The 2014 manifesto's sentence on this is one line long, and it is a restatement rather than a plan: "BJP reiterates its stand on the Article 370, and will discuss this with all stakeholders and remains committed to the abrogation of this article." No date, no mechanism, and an explicit commitment to consultation.
The commitment was acted on, in the following term rather than this one. On 6 August 2019 the Ministry of Law and Justice published in the Gazette of India a declaration by the President under Article 370(3), numbered C.O. 273. Its operative words: "as from the 6th August, 2019, all clauses of the said article 370 shall cease to be operative except the following" — the exception being a rewritten clause providing that "All provisions of this Constitution, as amended from time to time, without any modifications or exceptions, shall apply to the State of Jammu and Kashmir."
That is the whole of what Article 370 now says. The special constitutional position it had carried since 1950 was removed by a notification of a single page.
The Supreme Court examined the move and upheld it unanimously in December 2023. On the law, therefore, the promise is delivered and settled.
Two things belong alongside that. The first is the promise's own second clause. The manifesto said the party "will discuss this with all stakeholders". The change was carried through while Jammu and Kashmir was under President's Rule and its elected legislative assembly stood dissolved — Parliament supplied the recommendation that Article 370(3) requires in place of the state's constituent assembly. Whether that satisfies the manifesto's own consultation clause is a matter of judgement, and this fact-check records the fact rather than settling the judgement.
The second is what came with it. The same month, the Jammu and Kashmir Reorganisation Act split the state into two union territories — Jammu and Kashmir with a legislature, Ladakh without. The manifesto promised the abrogation of an article; the reorganisation of a state into union territories was not in it. Restoration of statehood has been stated as an intention in Parliament, and as of August 2026 it had not happened.
On the promise as written — abrogation of Article 370 — the record is unambiguous, and our verdict is accurate.
