The law exists and is not in force, and the manifesto's phrase 'systematically implement' obscures why. Article 334A, inserted by the 106th Amendment, makes the one-third reservation begin only after a delimitation carried out on the figures of the first census taken after the Amendment commenced. The Law Ministry confirmed in April 2025 that this is the position and that no state ratification was needed. The first census after the Amendment is Census 2027, whose first phase questions the Home Ministry has notified. Delimitation follows the publication of its figures. Nothing in the promise commits the government to a date, and no date has been set.
“Implementing the Nari Shakti Vandan Adhiniyam — We have enacted the long-awaited Nari Shakti Vandan Adhiniyam. We will systematically implement this to ensure representation for women in the Parliament and State Legislatures.”No CAG performance audit published
No CAG performance audit covering this scheme has been published. The absence of an audit is not evidence that the claim is either accurate or inaccurate.
The Act's commencement is a constitutional and administrative question, not an audited expenditure programme; no CAG report bears on it.
No audit period to plot — no CAG performance audit covering this scheme has been published.
Census 2027 first-phase questions notified; second phase to be notified in due course
The census is the first of the two conditions in Article 334A. The second — a delimitation exercise undertaken on the figures published from that census — has not begun.
Lok Sabha Unstarred Question No. 5278, Census 2027 Safeguards — answer by the Ministry of Home Affairs
The Constitution (One Hundred and Sixth Amendment) Act, 2023 — the Nari Shakti Vandan Adhiniyam — reserves one-third of the seats in the Lok Sabha, in state legislative assemblies and in the Delhi assembly for women. It passed both Houses in September 2023 and received assent. The 2024 manifesto records the enactment as done and promises to "systematically implement this to ensure representation for women in the Parliament and State Legislatures".
The word doing the work in that sentence is "implement". The Act is on the statute book; the reservation is not in force, and the Act itself is what stops it. Article 334A, which the Amendment inserted, says the reservation "shall come into effect after an exercise of delimitation is undertaken for this purpose after the relevant figures for the first census taken after commencement" of the Amendment "have been published".
Asked directly in April 2025 for the time frame by which constituencies would be redrawn, and whether reserved constituencies could be notified before the next Lok Sabha election, the Ministry of Law and Justice answered by quoting Article 334A back and stopped there. It gave no date for either step. It did clarify one point that has been widely misreported: under Article 368, ratification by state legislatures was not required, and none was sought. The Amendment is fully enacted.
So the sequence is: a census, then publication of its figures, then a delimitation exercise conducted for this purpose, then the reservation begins. The census leg has moved. The Ministry of Home Affairs confirmed in March 2026 that Census 2027 will be conducted digitally, that first-phase questions have been notified, and that second-phase questions will follow. That census — the first taken after the Amendment commenced — is the trigger the Article names.
The delimitation leg has not moved. No delimitation commission for this purpose has been constituted, and no government answer we located commits to a date for one. Until the census figures are published, none can be.
This is recorded as too early to judge, because a 2024-term promise carrying no date cannot be failed inside that term. It is recorded as lacking context because the phrase "systematically implement" is doing something a reader should see: the reservation's start date is not a matter of administrative diligence that a government can accelerate by working harder. It is written into the Amendment as a condition, and the condition was drafted by the same Parliament that passed the Act. A voter reading "we will systematically implement this" in April 2024 would not learn from it that the reservation could not begin before a census that had not then been scheduled.
